Wakeify Terms of Service

Wakeify is a free music alarm clock app for iPhone and iPad that wakes you up to any song, album, artist or playlist from Spotify or Apple Music.

Wakeify is made and published by Yuval Fatal, an independent developer ("we", "us"). By downloading or using Wakeify, or by using this website, you agree to these terms. If you do not agree, do not use the app.

1. Your licence to use Wakeify

Wakeify is licensed to you, not sold. You get a personal, non-exclusive, non-transferable, revocable licence to install and use the app on Apple devices that you own or control, for your own personal use, in line with the App Store Terms of Service.

Because Wakeify is distributed through Apple's App Store, Apple's Licensed Application End User License Agreement also applies to your copy. Where these terms and Apple's standard EULA conflict for App Store distribution, Apple's EULA governs; these terms supplement it with the things specific to Wakeify.

You agree not to:

• copy, sell, rent, sub-licence or redistribute the app;
• reverse engineer, decompile or disassemble it, except where the law expressly permits that despite this restriction;
• use it to break the law, or to breach the terms of Apple Music, Spotify or any other service it connects to;
• circumvent or interfere with the security of the app, the website, or the services they talk to.

2. What Wakeify does and does not promise

Wakeify schedules alarms that sound through silent mode and through Focus. It still depends on your device, your settings and your operating system, and an alarm can fail to sound for reasons entirely outside our control, including but not limited to:

• a discharged, powered-off or restarting device;
• alarm or Focus permissions that were declined or later revoked;
• ringer volume turned down, or a Focus mode configured to silence the app;
• iOS terminating background processes, or an operating-system update changing behaviour;
• time-zone or clock changes on the device;
• for Full Song mode specifically: no network, a lapsed Apple Music subscription, or the music app being closed.

Do not rely on Wakeify alone where missing an alarm would be dangerous or seriously costly: medication schedules, medical appointments, shift work with safety implications, flights. Use a second alarm. We are not liable for anything that follows from a missed wake-up.

3. Music services and content

Wakeify does not host, own or supply any music. It lets you choose something from Apple Music or Spotify, or one of the alarm tones provided by iOS. Your use of each service remains subject to that company's own terms and to whatever subscription you hold with them.

Wakeify is an independent app. It is not affiliated with, endorsed by, sponsored by or certified by Apple Inc. or Spotify AB. Catalogue availability, playback rights and account rules are set by those services and can change without notice; if a track stops being available, the alarm falls back to a default tone.

A Spotify alarm works with a free Spotify account. Full Song mode, which plays the complete track, requires an active Apple Music subscription, and you are responsible for holding whatever accounts a given feature needs.

4. Price, purchases and refunds

Wakeify is currently free, with every feature unlocked, and the app presents no purchase screen. We may introduce paid features in a future version. If we do:

• any purchase you have already made remains valid;
• all payments are processed by Apple through the App Store, never by us directly;
• subscriptions renew and cancel through your Apple account settings, on Apple's terms;
• refunds are handled by Apple under its own policy. We cannot issue them, though we are happy to support a request you make to Apple.

5. Changes to the app

Wakeify is actively developed. Features may be added, changed or removed, and the minimum iOS version Wakeify requires may rise. We are not obliged to keep any particular feature available indefinitely. Significant changes will be described in the App Store release notes.

6. This website

wakeify.app is provided for information and support. Its content is offered in good faith and may be updated at any time. Links to other sites are provided for convenience and imply no endorsement, and we are not responsible for their content.

7. Intellectual property

The Wakeify name, app icon, artwork, interface design, copy and source code belong to Yuval Fatal and are protected by copyright and trademark law. Nothing in these terms transfers any of it to you. Third-party names and logos shown in the app or on this site (Apple, Apple Music, App Store, iPhone, iPad, Spotify) belong to their respective owners and are used only to identify the services Wakeify works with.

8. Privacy

The privacy policy explains exactly what the app collects, which is very little, and how to switch it off. It forms part of these terms.

9. Disclaimer of warranties

To the fullest extent the law allows, Wakeify and this website are provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that every alarm will sound.

10. Limitation of liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, income, data, opportunity, sleep or goodwill arising out of your use of, or inability to use, Wakeify, including a missed alarm. Where liability cannot lawfully be excluded, it is limited to the greater of the amount you paid for the app in the twelve months before the claim, or ten US dollars.

11. Your rights as a consumer

Nothing in these terms removes or limits any right you have under the mandatory consumer protection law of the country where you live. If a provision here is unenforceable in your jurisdiction, it is severed and the rest continues to apply.

12. Age

Wakeify is a general-audience app and is not directed at children under 13. If you are under the age of majority where you live, use it with a parent's or guardian's permission.

13. Ending the agreement

You can end this agreement at any time by deleting the app. We may suspend or end your licence if you materially breach these terms. Sections 7, 9, 10 and 11 survive the end of the agreement.

14. Changes to these terms

These terms may change as the app changes. The date at the top of this page shows when they were last revised, and continuing to use Wakeify after a revision means you accept it. Material changes will not be applied retroactively.
